By using Fire Nearby (firenearby.com), you agree to these terms. They exist mainly to make one thing unmistakably clear: this site is an information aggregator, not an emergency service.

Safety first: never rely on this site for life-safety decisions

Fire Nearby is not an official emergency service, is not a warning or alerting system, and is not affiliated with any government agency. Wildfire data can be delayed, incomplete, or wrong, and fires can move faster than any data source updates. For evacuation and safety decisions, always follow instructions from local emergency officials, official alerting systems, and law enforcement. If you are in immediate danger, call 911 (or your local emergency number) and leave. Do not wait for this or any website to confirm what you can see or are being told locally.

1. The service

Fire Nearby aggregates publicly available wildfire, weather, air-quality, and related data from government and public sources into maps, pages, and summaries. Every number on the site depends on upstream sources that we do not control; those sources can lag, go offline, revise their data, or publish errors, and our processing can introduce errors of its own. Timestamps and freshness indicators across the site show when data was last updated, and you should always check them.

2. Acceptance of these terms

By accessing or using the site, you accept these terms and our Privacy Policy. If you do not agree, do not use the site. We may update these terms from time to time; the current version always lives at firenearby.com/terms, and continued use after an update constitutes acceptance.

3. Acceptable use

You agree not to:

  • Republish, resell, or redistribute the site’s data feeds, APIs, or derived signals as a product or service, or represent them as your own.
  • Present information from this site as an official warning, evacuation order, or government communication.
  • Use automated tools (scrapers, bots, bulk downloaders) in a way that burdens the service, circumvents access controls, or harvests data at scale. Reasonable personal and research use of public pages is fine.
  • Interfere with the operation or security of the site, or attempt to access non-public systems or data.
  • Use the site in violation of applicable law.

4. No warranty

The site and all of its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including without limitation warranties of accuracy, completeness, timeliness, reliability, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that any fire, hazard, or condition will appear on the site at all, promptly, or accurately.

5. Limitation of liability

To the maximum extent permitted by law, Fire Nearby and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of, or inability to use, the site or its data. This includes, without limitation, damages for personal injury, property loss, evacuation decisions, business interruption, or reliance on any information presented, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in those cases our liability is limited to the fullest extent permitted by law.

6. Indemnification

You agree to indemnify and hold harmless Fire Nearby and its operators from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site or violation of these terms.

7. Intellectual property and attribution

The site’s design, code, original text, and the organization and presentation of its content belong to Fire Nearby. The underlying wildfire, weather, and air-quality data come from government and public sources (including NIFC/IRWIN, CAL FIRE, NOAA, the National Weather Service, NASA FIRMS, CWFIS, EPA AirNow, and others listed on our About page) and remain subject to those sources’ own terms. Basemap data is © OpenFreeMap, OpenMapTiles, and OpenStreetMap contributors. Agency names and logos belong to their owners; their appearance on this site identifies data sources and does not imply endorsement of Fire Nearby by any agency.

8. Third-party links and services

The site links to official agency websites and other third-party resources. We are not responsible for their content, availability, or practices. Your use of third-party services is governed by their own terms.

9. Changes and availability

We may add, change, suspend, or discontinue any part of the site at any time without notice, including data sources, features, and pages. We have no obligation to maintain the availability of the site or any specific data.

10. Governing law

These terms are governed by the laws of the United States and the state in which Fire Nearby is operated, without regard to conflict-of-law rules. If any provision of these terms is found unenforceable, the remaining provisions stay in effect.
